Terms of Service

Wholesale pallet sales carry different rules than retail shopping. Here are ours: the merchandise we sell, how payment and freight work, what your 72-hour inspection window covers, and the limits of what we can promise.

Before you buyRead §3: the goods are graded and sold as-is

The one-paragraph version

You are buying graded liquidation merchandise as is: retail returns, overstock and closeout goods graded A, B or C, sold by the pallet with a manifest, delivered by LTL freight, paid offline before we load. You get 72 hours from delivery to report a pallet-count shortage or transit damage. After that, the sale is final. There is no warranty and no return for “it isn’t what I expected”. If that suits how you buy, welcome aboard.

1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of the palletliquidationking website and every order you place through it. By creating an account, placing an order, or otherwise using the site, you agree to these Terms in full.

If you do not agree with any part of these Terms, do not use the site. If you are accepting on behalf of a company, you confirm you are authorised to bind that company, and “you” includes that company.

These Terms apply alongside our Privacy Policy and Shipping Policy, both of which are incorporated by reference.

2. Eligibility & accounts

  • You must be at least 18 years old and legally able to enter a binding contract.
  • An account is required to check out. Guest checkout is not offered. This lets us tie every order, manifest and claim to a verified buyer.
  • You are responsible for keeping your password confidential and for all activity on your account. Tell us immediately at sales@palletliquidationking.com if you suspect unauthorised use.
  • You must provide accurate, current information. False or fraudulent account details, or orders placed with a payment instrument you do not own, are grounds for immediate cancellation without refund.
  • One account per buyer. We may decline or close accounts that show a pattern of suspected fraud, payment reversals, or resale of our listings as their own storefront.
  • We may suspend or close an account at our discretion, for example for abusive conduct towards staff, repeated chargebacks, or breach of these Terms.

3. The goods: graded, manifested, as-is

This is the section that matters most. Liquidation stock is not new retail merchandise, and treating it like new retail merchandise is the single most common source of disagreement in this trade.

3.1 What our pallets actually contain

  • Retail returns: goods returned to the original retailer for reasons including open-box, customer remorse, damaged packaging, cosmetic wear, or a returned item that is otherwise functional.
  • Overstock, closeout and discontinued lines: unsold inventory. Genuine and never used, but the packaging or assortment may differ from current retail.
  • Mixed-brand and mixed-condition lots: where a pallet is built from more than one source, brand, category or grade.
  • Seconds or repaired units: where disclosed, units with cosmetic or functional defects.

3.2 Grading

Every pallet is graded at intake and the grade appears on the product page and on your manifest. Grading is a judgement applied to a pallet as a whole, not a certification of each individual item inside it.

GradeTypical meaning
AMostly new, minimal signs of handling. Packaging may be open, plain or resynced. Little to no wear.
BReturns and light overstock. Noticeable cosmetic wear, scuffs, small packaging imperfections. Units generally function.
CHeavy returns, mixed condition, scratched or dented units, incomplete assortments, cosmetic defects. Discounted accordingly.

Carton and item condition will vary within a pallet, sometimes significantly. A Grade B pallet is an average across the load, not a floor. Grading is based on intake sampling and visual inspection; we cannot test every unit, so treat electronics and high-value categories as untested unless the listing says otherwise.

3.3 The manifest

Each pallet ships with a manifest listing what we counted at intake: brands, categories, approximate unit counts and grades. The manifest is a best-effort description produced before the pallet leaves our dock. It is not a warranty of what any individual carton contains, and it is not a substitute for your own inventory count.

3.4 Weight and carton counts

Published weights and carton counts are estimates derived at intake, including packaging. Actual shipped weight is confirmed on the carrier’s bill of lading. Carton counts are estimates and can vary by unit count, unit size and how the pallet was built. Plan your dock, trailer and labour around the weight shown, not the carton count.

3.5 Listing accuracy

We work hard to photograph and describe each load honestly, including known defects and brand restrictions. Product photography is representative of the load as a whole, not of every carton. Because inventory changes continually, we may withdraw or correct a listing at any time before your order is accepted, and we will tell you promptly if that happens.

4. Orders, acceptance & availability

4.1 Placing an order

Placing an order is an offer to buy. We accept your order only when we send you a confirmation email and move the order to Processing. Until then we may decline it in full without any obligation, for example if the load is already spoken for, if stock figures were inaccurate, or if we cannot service your delivery address.

4.2 Order statuses

StatusMeaning
PendingReceived. Awaiting payment and our review of load availability. Nothing is reserved until payment clears.
ProcessingBeing picked, inspected, manifested and photographed. Freight quote being finalised.
ShippedOn the truck. You receive the PRO number and carrier contact details to schedule delivery.
DeliveredFreight delivered. Your 72-hour inspection window starts on delivery.
CancelledOrder cancelled and not fulfilled. Any payment taken is refunded in full to the original method.

4.3 Availability and substitutions

  • Stock counts shown on the site are indicative. We verify availability at the point we process your order.
  • If a pallet you ordered is unavailable, or only part of your order can be filled, we will contact you before dispatch and you may choose a substitute load of equal or greater grade, a partial shipment, or cancellation with a full refund of the affected amount.
  • If a substitute is required and we cannot reach you, we may hold your order rather than ship something you did not agree to.
  • We do not back-order sold-out pallets. A sold-out listing is removed from the storefront.

4.4 Changes and cancellations by you

You may cancel or amend an order by emailing sales@palletliquidationking.com before the order is marked Shipped. Once a load is on a truck we cannot recall it. Changes are not guaranteed until we confirm them in writing.

5. Pricing, payment & taxes

5.1 Currency and pricing

  • All prices are in US dollars (USD) and exclude freight unless expressly stated.
  • Pallet prices are per pallet and are fixed at the time your order is accepted.
  • Freight is quoted separately per shipment, based on pallet count, weight, distance and delivery type. You will see the quote in writing before the load is released.
  • Handling and inspection are included in the pallet price. Staging, inside delivery, extra liftgate or re-delivery fees are not, and are billed by the carrier.
  • Prices may change without notice, but never retroactively for an order we have already accepted.

5.2 How payment works

Payment is arranged offline and manually after your order is confirmed. We accept the following methods, selected at checkout:

  • Bank wire
  • Crypto
  • Zelle
  • Apple Pay
  • Chime
  • Cash App
  • There is no card checkout, and we never ask for or store card numbers, CVVs or online banking credentials.
  • We send full payment instructions with your confirmation and invoice. Payments are applied to the exact order they refer to. Please include your order number in the reference.
  • Pallets are not released for shipment until funds have cleared and are final. For bank wires this can take 1–3 business days. For crypto we wait for the required network confirmations.
  • Overpayments, rounding differences and residual balances are refunded at our discretion after delivery.

5.3 Payment risk you accept

Peer-to-peer payment methods such as Zelle, Apple Pay, Chime and Cash App can be reversed by the sender after goods have shipped, and a bank wire can be recalled. You accept that risk. If a payment is reversed, charged back or dishonoured:

  • We may cancel future orders and require payment in advance by bank wire or crypto.
  • We may pursue recovery of the goods or their value, plus reasonable collection costs.
  • We may report the account to the relevant payment provider.

5.4 Taxes

Pallet prices are quoted exclusive of sales tax, use tax, VAT and duties. Where we are required to collect tax, we add it to the final invoice before you pay and it appears as a separate line. Any import duty, customs charge, brokerage fee or tax imposed on an international shipment is the buyer’s responsibility and is not refundable by us.

6. Freight & delivery obligations

All pallets ship by Less-Than-Truckload (LTL) freight only, typically on a 53-foot tractor-trailer. Full detail is in our Shipping Policy, which forms part of these Terms. In summary:

  • You must have a forklift, pallet jack or loading dock at the delivery address. Freight drivers do not hand-unload and we do not provide inside delivery.
  • Residential delivery requires liftgate service and carries an additional fee (typically $75–$150). Inside delivery is unavailable.
  • Someone aged 18 or over must be present, and the delivery address must be reachable by a 53-foot trailer with no low bridges, narrow roads or steep driveways.
  • Scheduling the delivery appointment with the carrier is the buyer’s responsibility once the PRO number is issued.
  • Freight delays caused by weather, carrier routing, truck availability, or the absence of a forklift or dock at your address are outside our control. See §10.

Please tell us about dock constraints, narrow streets, apartment or unit numbers, and appointment restrictions before you order. We will flag anything we think will cause a problem.

7. Your 72-hour inspection window

Every load is covered by a 72-hour inspection window running from delivery. This is the single remedy we offer, and it is time-limited and evidence-based.

7.1 At the tailgate: before you sign

Freight law requires you to inspect the delivery before accepting it:

  • Count the pallets against the manifest.
  • Check for visible damage: crushed corners, punctures, broken banding, missing or torn stretch wrap, water staining, shifted or leaning stacks.
  • Note any damage, shortage or exception on the delivery receipt / bill of lading before signing.
  • Photograph damage.
  • If you sign “clear” and discover damage afterwards, the carrier will almost certainly deny the claim, and so will we.
  • You have the right to refuse visibly damaged freight. If you do, photograph everything, note the refusal on the delivery receipt, and tell us immediately. We will pursue the claim with the carrier.

7.2 Within 72 hours of delivery: concealed damage and shortage

Concealed damage (damage that could not reasonably be seen at the tailgate) or a genuine pallet-count shortage must be reported to us within 72 hours of delivery. Your report must include:

  • Your order number
  • Photographs of the pallet, the damage and the shipping label
  • A clear description of what is wrong and how many units or pallets are affected
  • Confirmation that you counted and inventoried the load

Reports received after 72 hours cannot be validated against the carrier’s documentation and cannot be supported. We cannot accept them.

7.3 What we will do

  • Where shortage or freight damage is documented inside the window, we will file the claim with the carrier on your behalf and keep you updated.
  • Where we agree with you and a carrier denies the claim, we may at our discretion issue a partial credit or refund against the affected pallet. This is the full extent of our remedy for damage or shortage.
  • Our decision on claims under this window is final and binding.

What the inspection window is not

It is not a general satisfaction guarantee, a return window, or a way to change your mind. It does not cover goods that arrived as described, items you simply prefer not to sell, or cosmetic differences you did not report within 72 hours. Full details in §8 and §9.

The same process in plain English: what the 72-hour inspection window actually is.

8. Cancellations, returns & refunds

8.1 If we cancel

If we cancel your order for any reason (stock unavailable, load problem, payment failure, or our own error), any payment taken is refunded in full to the original method of payment. This is the only situation in which we refund money for goods you have not received.

8.2 If you cancel

You may cancel before the order is marked Shipped. If payment has cleared, it is refunded in full. Once a load is on the truck we cannot cancel, recover or return it.

8.3 Returns: not accepted

Liquidation merchandise is sold as-is and is not returnable. We do not accept returns of delivered pallets under any circumstances, including:

  • The pallet contains fewer saleable units than you expected
  • Brands, sizes or categories differ from what you hoped for
  • A unit does not power on, hold a charge, or is otherwise not to your liking
  • Condition falls short of your own resale standards
  • You ordered the wrong grade, category or quantity
  • You over-ordered

The only post-delivery remedy is the documented damage / shortage claim process in §7, and it must be used within 72 hours.

8.4 Refunds, how and when

  • Refunds are issued to the original method of payment. Bank wires return by wire; crypto returns are sent to the wallet address you provide in writing; Zelle, Apple Pay, Chime and Cash App refunds are sent back through the same service and may take several business days to appear.
  • We cannot refund to a different account, wallet or recipient than the payer, and we will ask for proof of payment where a method has no transaction history.
  • Refund processing begins within 5 business days of approval. Your bank or payment provider may take a further 3–10 business days to post it.
  • Freight charges already incurred are non-refundable once a load has shipped.

9. No warranty

All goods are sold “as is” and “with all faults”. To the fullest extent permitted by law, we disclaim all express, implied, statutory and oral warranties, including any warranty of merchantability, fitness for a particular purpose, satisfactory quality, title, non-infringement, or accuracy of the manifest, listing photographs, descriptions, weights or carton counts.

This includes, without limitation:

  • No warranty that any unit works, powers on, holds a charge, or is free of defects.
  • No warranty that a unit is genuine, complete, or includes the accessories shown in listing photographs.
  • No warranty that a unit is free of manufacturer cosmetic or functional defects typical of returns.
  • No warranty of any kind on batteries, lithium cells, or perishable, cosmetic or consumable goods.
  • No warranty relating to any claim you make against the original manufacturer or retailer. Those claims, if any, remain yours to pursue.

Some jurisdictions do not allow the exclusion of implied warranties or certain remedies for graded / as-is goods. Where a term is void under your local law, it is read down to the minimum extent necessary and the remainder of these Terms continue to apply. Your sole and exclusive remedy remains the process in §7.

10. Limitation of liability

To the fullest extent permitted by law, palletliquidationking and its staff, owners and carriers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, sales, goodwill, data or anticipated savings, even if we were told the possibility existed. This includes lost or reduced resale margin, lost marketplace listings, wasted labour, customer complaints, marketplace account suspension, and the cost of unsold inventory.

Our total aggregate liability arising out of or relating to an order is limited to the amount you actually paid us for that order, excluding freight. Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, gross negligence, or death or personal injury caused by negligence.

We are not responsible for:

  • Freight delays or failures caused by weather, road closures, carrier routing or scheduling, dock congestion, or carrier labour issues.
  • Failure to deliver because the address had no forklift, pallet jack or dock, or no one was present to receive the load.
  • Carrier damage claims the carrier declines, particularly where damage was not noted on the delivery receipt.
  • Storage, handling, testing or resale of goods after delivery. That is your operation and your risk.
  • Indirect loss arising from any of the above.

11. Your obligations as a reseller

Our buyers resell. What you do with the goods after delivery is entirely between you and your customers and marketplaces. You agree that:

  • You are the seller of record. Any warranty, refund, disclosure or description you make to your end customers is your sole responsibility, and you must not represent our warranty or inspection window as if it were yours.
  • You must not describe the goods as new where grade, packaging or condition does not support it, and you must disclose material condition information to your buyers as required by your sales channel.
  • You must comply with all laws and marketplace policies that apply to your resale, including consumer protection, product safety, labelling and country-of-origin rules, and any restrictions on brand or category.
  • You must not misrepresent our site, pricing, manifests or photographs as your own, and must not present yourself as palletliquidationking or as an authorised distributor unless you have our written agreement.
  • You are responsible for your own tax reporting on the sale of goods.
  • Do not submit orders using false identities, throwaway email addresses, or payment instruments that do not belong to you.

12. Acceptable use

You agree not to, and not to permit anyone using your account to:

  • Scrape, crawl, harvest or bulk-copy listings, photographs, manifests or prices for a competing marketplace or price-comparison service.
  • Republish our product photography or copy without written permission.
  • Place orders you have no intention of paying for, or use multiple accounts to exceed per-buyer limits.
  • Attempt to gain access to the admin panel, other customer accounts, or our underlying systems.
  • Interfere with, probe, overload or disrupt the site, or circumvent any rate limit or security control.
  • Transmit malware, or use the contact form, live chat or email for unsolicited commercial or illegal content.
  • Misrepresent your identity, or impersonate another buyer or a member of our staff.
  • Use the site to buy or sell anything unlawful.

Breach of this section entitles us to suspend your account, refuse future orders, and pursue any losses. We also operate technical measures that limit automated access to this site; attempting to bypass them is a breach of these Terms.

13. Site content & intellectual property

The website, its design, the palletliquidationking name and logo, product descriptions, grading methodology, photographs, videos, manifest templates, layout and underlying software are owned by us or our licensors and are protected by copyright, trademark and other intellectual property laws.

  • You may not copy, republish, frame, mirror or systematically extract site content for commercial reuse.
  • Product photography is licensed to you for the sole purpose of listing and selling the specific pallet you purchased. It may not be reused for other loads or other pallets.
  • You may quote our Terms and policies in full, unaltered, with clear attribution and a live link, for example in your own store’s policy pages.
  • Feedback you volunteer about the site may be used by us without restriction or obligation.

14. Earnings figures & testimonials

Reseller profit figures, margin multiples, pallet counts shipped and any testimonial on this site are illustrative and historical. They describe particular buyers and particular loads under particular conditions.

  • We do not promise, warrant or guarantee any earnings, profit level, ROI, sell-through rate or margin.
  • Results depend entirely on the load you buy, its grade, your pricing, your marketplace, your shipping costs, your labour and your market.
  • Testimonials are not a substitute for your own due diligence. Testimonials may or may not reflect the experience of other buyers.
  • The typical retail value figures shown on listings are reference values from original retail pricing, not guaranteed resale prices, and are not a valuation.

15. Third-party services & carriers

Our site links to and relies on independent services, including freight carriers, payment apps and marketplaces. Their services are provided under their own terms and privacy policies, not ours. We are not responsible for third-party services, their content, availability or practices, though we remain responsible for properly handling your personal data, as set out in our Privacy Policy.

16. Indemnity

You agree to indemnify, defend and hold harmless palletliquidationking and its owners, employees and agents from and against any third-party claim, demand, loss, damage, cost or expense, including reasonable legal fees, arising from or connected to: your breach of these Terms; your misuse of the goods or your breach of any law or marketplace policy in reselling them; any warranty, representation or claim you make to your end customers; any allegation that goods as described by you infringe a third party’s rights; and any claim arising from your payment method being reversed, charged back or dishonoured.

17. Disputes & governing law

17.1 Talk to us first

Nearly every dispute in this trade is a misunderstanding about condition, count or freight, and nearly all of them are resolved fastest by a phone call. Before starting anything formal, email sales@palletliquidationking.com or call +1 (510) 778-4319 with your order number. We will respond within one business day.

17.2 Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. The United States District Court for the Eastern District of California and, where that court lacks jurisdiction, the state courts located in Sacramento County, California, have exclusive jurisdiction over any dispute arising from these Terms or your use of the site, and both parties consent to that venue.

You and we each waive any right to a jury trial and to participate in a class or representative action. Nothing prevents either party from seeking urgent injunctive relief in a court of competent jurisdiction to protect its data or intellectual property.

17.3 Severability and waiver

If any provision of these Terms is held unenforceable, it is modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions continue in full force. A delay in enforcing a provision is not a waiver of it. No waiver is effective unless in writing and signed by us.

18. Changes to these terms

We may update these Terms to reflect changes in our business, the law, or how we operate. The “Last updated” date at the top of this page shows the current version. The version in effect on the date your order was accepted is the version that governs that order. Later changes do not retroactively alter your existing order. Material changes will be announced by email or a notice on the site.
